What is an Uncontested Dissolution?
An uncontested dissolution is an divorce proceeding where both the husband and wife have agreed to all the terms of the divorce settlement prior to filing.

This means that the parties have divided their own property, debts, and have reached an agreement on how to handle issues of child support and visitation with the children.

In order to have an uncontested divorce, ALL of these issues have to be worked out in advance PRIOR to the case being filed.

Ending a marriage using the uncontested method allows you and your spouse the opportunity to end your marriage with respect and dignity. It is the best possible thing in the world for the children of the marriage as they are not disrupted or forced to take sides if their was a long drawn out battle in Court.

This is a distinct advantage over using some do it yourself program or a generic divorce website that has access to all fifty states. Of course, an uncontested dissolution means much less cost. Since you and your spouse have worked out the details of how you will divide up your marital estate, there is nothing to litigate. All the attorney has to do is take your information and prepare the information according to the legal standards, local rules, and proper forms that the Court and Court Clerk will accept to get the case started and finished on schedule.

Uncontested divorce avoids a lot of the animosity and hatred that develops during the end of a marriage. However, it isn't for everyone. Perhaps you and your significant other own a series of real estate properties or if you have children who will have unusual parenting needs, then an uncontested dissolution may not prove satisfactory for either one of you.

In an uncontested dissolution, the biggest advantage is that you get to stay human. Mr. Jump has done many dissolution cases where the parties simply become vicious and mean to hurt the other individual in the marriage. It is the 'pound of flesh' syndrome. While a contested motion win might bring about a quick victory and the ability for one spouse to gloat over the other, in the long run, it simply isn't a winning formula. Better to retain you dignity now and simply dissolve the marriage with an agreed upon set of documents.

Once the documents are sent to you, you will have them signed and notarized in all of the correct places. You will then return them to us with the filing fee and we will file them with the local Court.
